Article 1. Application of the GTC
1.1 Les présentes conditions générales de vente s'appliquent à toutes commandes de billets Internet passées sur le site Internet www.ticketsdordogne.com.
La Société d’Exploitation Semitour se réserve la possibilité de les adapter ou de les modifier à tout moment. Dans ce cas, il serait appliqué les conditions générales de vente en vigueur au jour de la commande.
Article 2. Contractual relations
2.1 The information on the Semitour's website and brochures for the current year may be subject to changes of which the Customer shall be informed prior to the conclusion of his order.
2.2 Semitour shall be the sole contact for the customer and shall be liable to the customer for the fulfilment of the obligations arising from these terms and conditions of sale. Semitour shall not be liable for damage resulting from force majeure or from any third party to the organisation, the conduct of the visit and the services provided on that occasion.
2.3 The customer acknowledges having the legal capacity to enter into a contract and to accept the conditions described herein.
2.4 The offers of sale proposed on the www.ticketsdordogne.com site, governed by the present conditions of sale, are valid as long as they remain online until the allocated places are exhausted. In fact, they may vary in real time.
Until the last minute, visit times are subject to change without changing the characteristics of the service.
Article 3. Prices
3.1 The prices shown on the website and in the brochures for the current year of the Semitour are applicable until the annual closing date and include all taxes. They are determined on the basis of the economic conditions in force on the date the price list is drawn up and may be revised after the order has been placed, but only in the event of a change in the taxes relating to the services sold or other taxes incurred.
3.2 As soon as the ticket order (reservation) is validated and paid for, Semitour cannot retroactively apply discounts and one-off promotional offers.
Article 4. Payments
4.1 You have 15 minutes from seat selection to validate your purchase. Beyond this time, the tickets are automatically put back on sale.
4.2 Any validated order makes the reservation firm and definitive.
4.3 All payments will be made in euros.
4.4 Payment by credit card allows the customer to purchase tickets online, it being specified that only one method of payment is authorised per order.
4.5 Accepted bank cards are those of the Carte Bleue, Visa and Mastercard networks, which are valid and not subject to bank opposition.
4.6 Payment by credit card is made on the secure bank servers of our partner PAYBOX. This implies that no banking information concerning the customer transits via the Semitour Périgord site. Payment by credit card is therefore perfectly secure; the customer's order will thus be recorded and validated as soon as the payment is accepted by the customer's bank.
4.7 Payment must be made at the time of the order, by bank card exclusively by means of the secure payment system without any additional costs.
4.8 Semitour is not responsible for any costs on credit card transactions caused by exchange rate variations or other reasons.
4.9 All payments made on the website are made via the secure payment platform, which implies that no banking information concerning the customer transits via the www.ticketsdordogne.com website. Payment by credit card is therefore perfectly secure; the customer's order will thus be recorded and validated as soon as the payment is accepted by the bank chosen by the customer.
4.10 La Semitour reserves the right to refuse to honour an order for tickets from a customer who has not fully paid for a previous order or with whom a payment dispute is in progress.
4.11 The date of validation of the ticket order corresponds to the date of the order and its payment by online bank card (law of 13 March 2000 on electronic signature).
4.12 As soon as payment is accepted, the purchaser receives 3 emails, one summarising his order, another containing his tickets and finally a third containing the customer's CB ticket (to be kept and produced in the event of a dispute).
Article 5. Cancellation
5.1 The sale of admission tickets for a museum or services linked to it is treated as a sale of leisure services and, in accordance with Article L 121-21-8-12° of the New Consumer Code, does not give rise to any right to the withdrawal period.
5.2 No cancellation or modification is therefore possible except in cases of force majeure (illness, death, wars, riots, insurrections, fires, earthquakes, storms and floods) and subject to proof being sent (for death and illness) at least 48 hours before the visit to the following email address: firstname.lastname@example.org.
5.3 Tickets are non-transferable, non-exchangeable and cannot be resold.
Article 6. Validity
6.1 The number of reserved places per transaction may not exceed 19, all fare categories combined.
6.2 Internet ticket orders dated and purchased via the www.ticketsdordogne.com website are only valid for the date and time chosen by the customer at the time of the order. Changing the date or timetable is not possible once the order has been validated.
6.3 Orders for children's Internet tickets may be subject to a check on the age of the child when entering the ticket office. Semitour is entitled to charge the difference with the adult fare ticket in force.
6.4 Semitour cannot under any circumstances be held liable in particular in the event of loss or theft of the ticket order. No duplicate tickets can be issued on the spot.
Article 7. Presentation of tickets
7.1 The e-ticket entitled "ticket" received by e-mail after the order has been placed must be presented at the cash desk on the day of your visit. This document can be presented printed on white A4 paper, or on a portable digital medium.
7.2 Printed document: The functionality of printing orders for tickets purchased via the Internet involves printing the said documents on an ordinary printer from an Internet access. The customer must ensure that the printed ticket orders have good print quality and must comply with the conditions of validity described below. Partially printed, soiled, damaged or illegible documents will not be accepted and will be considered de facto invalid. In the event of poor print quality, the customer must reprint his or her Internet ticket order(s) in order to have a good print quality. The customer will be able to check the print quality by ensuring that the written information on the Internet ticket order as well as the QR code are legible. Semitour declines all responsibility for any anomalies that may occur during the ordering, processing or printing of Internet ticket orders that can be printed by the customer. The ticket can be presented to the host/ cashier/guide from a portable digital medium (mobile phone or tablet). This implies that the customer has downloaded the said document prior to coming to the venue and that he has ensured that his mobile device is working properly. The customer must present the document in such a way that the barcode can be scanned directly without any intervention by Semitour staff. Partially downloaded, damaged or illegible documents shall not be accepted and shall be considered de facto invalid. Semitour declines all responsibility for any anomalies that may occur during the ordering, processing or downloading of Internet tickets that can be downloaded by the customer.
7.3. Each printed or downloaded Internet ticket order is provided with a unique QR code, checked and recorded at the entrance to the sites. It is not possible to be admitted to the entrance of the sites more than once with the same Internet ticket order. Only the first person to present the Internet ticket order will be admitted; this person is presumed to be the legitimate bearer of the order. Internet ticket orders are personal and non-transferable.
Article 8. Security of personal data
8.1 Semitour Périgord, the data controller, is required to collect, use, transfer, store or carry out any other processing of personal data concerning the customer for the management of his order, the finalisation of his transaction and/or his information. More specifically, this data is processed by Semitour Périgord in order to carry out the following operations:
- Sending information and requests
- Carrying out statistical studies.
8.2 In accordance with the modified law of January 6, 1978 called "Informatique et Libertés" and the European regulation 2016/679 of April 27, 2016 called "Règlement Général sur la Protection des Données", you have the right to access, rectify, modify and delete data concerning you. You can thus demand that any information concerning you that is inaccurate, incomplete, ambiguous or out of date be rectified, completed, clarified, updated or deleted. You can also exercise your rights to oppose and limit the processing of your data as well as your right to the portability of the information concerning you.
8.3 In order to exercise your rights, you may send a request by e-mail to the following address: email@example.com. You also have the right to appeal to a national supervisory authority such as the Commission Nationale de l'Informatique et des Libertés in the event of a breach of the applicable regulations on the protection of personal data.
Article 9. Security of payments
9.1 Semitour Périgord's payment site uses the PAYBOX payment platform which complies with the 3D-secure standard.
9.2 To improve the security of online ticket sales, Semitour has implemented the 3D Secure system. This is a protocol that requires additional identification by the customer in order to best combat credit card fraud on the Internet.
Article 10. Applicable law
10.1 Any dispute for any reason whatsoever shall be the subject of an attempt at conciliation by sending a registered letter with acknowledgement of receipt, this attempt at conciliation being however not a prerequisite to the request for precautionary measures
10.2 In accordance with the provisions of Article L.133-4 of the French Consumer Code, the consumer customer is informed of the possibility of resorting, in the event of a dispute, to a conventional mediation procedure or any other alternative dispute resolution method.
10.3 In the absence of an amicable solution within thirty (30) calendar days from receipt by the party receiving the request for conciliation, any dispute concerning the formation, validity, interpretation, performance or termination of the contract shall be referred to the competent courts. The parties elect domicile at the Semitour's head office, the court of Périgueux will have sole jurisdiction.
